The European Constitution

About this book

"This book offers a selection of materials that enable a better understanding of some of the most important changes that would be introduced by the Treaty establishing a Constitution for Europe in the EU legal and political system. It also helps to assess the need for the reforms embedded in the Constitutional Treaty as well as the quality of the formulations agreed upon by the signatory Member States." "The book includes excerpts of the European Convention's work, selected statutory and constitutional provisions of the Member States, and also related passages from pertinent court decisions - from both European courts as well as Member States' constitutional courts. Institutional and doctrinal analyses and relevant excerpts from the Constitutional Treaty itself are also included. Many of these documents directly relate to the provisions of the Constitutional Treaty, while the others, although not directly related, are nevertheless relevant to the debate surrounding it." "The European Constitution will be of great interest to researchers and teachers in the fields of European Law and European politics, and also to policy makers in European affairs."--Jacket.

The constitution as political structure

Martin H. Redish

Over the last forty years modern constitutional scholarship has concentrated on an analysis of rights, while principles of constitutional law concerning the structure of government have been largely down-played. The irony of this interpretive emphasis is that the body of the Constitution contains relatively little dealing directly with rights. Rather, it is primarily a blueprint for the establishment of a complex form of federal-democratic structure. The Constitution as Political Structure emphasizes the central role served by the structural portions of the Constitution. Redish argues that these structural values were designed to provide the framework in which our rights-based system may flourish, and that judicial abandonment of these structural values threatens the very foundations of American political theory. In its exposition of the textual and theoretical rationales for judicial enforcement of the structural values embodied in the Constitution, this book presents a principled alternative to the extremes of judicial abdication articulated by certain scholars and Justices on the one hand, and the result-oriented ideological involvement advocated in some quarters on the other. This work will be of great interest to scholars of law and political science.

The second long march

Peter Kien-hong Yu

"This work, written by an expert in the politics of Mainland China and Taiwan, looks at the role the Constitution of the Republic of China has played in the development of Taiwan since 1949 and its potential influence on the People's Republic of China. The Chinese Communists conducted the first long march for the sake of the majority of Chinese people, with the victory of MAO Zedong. In the second long march, CHIANG Kai-shek and his successors tried to convert the Chinese mainland from a Communist, totalitarian system, into a democratic, prosperous one by relying on the spirit of the Republic of China (ROC) constitution and by setting itself as a good example, in gradually guaranteeing freedom and democracy. Needless to say, this march is long and difficult. The Second Long March challenges other models and theories on the study of the relationship between the ROC (Taiwan area) and mainland China or the People's Republic of China (PRC) since China became politically (as opposed to legally) divided in December 1949. Arguably, it is the ROC Constitution that has helped ROC citizens to live in a non-Communist or anti-Communist political system. Actively promoting democracy and freedom on the Chinese mainland (neidi) can further guarantee the Taiwan area's survival. The book will provide valuable scholarship of interest to anyone researching the political history of China and its prospects for democratization."--Bloomsbury Publishing.

"Addressing the trust deficit that has developed between the people of Afghanistan and the international community, the authors of this book grapple with key issues related to the implementation of a drawdown strategy. Their analyses and recommendations cover a broad range of topics, including Afghanistan's security environment, governance and the rule of law, the role of civil society, development, and reconciliation and reintegration."--Page 4 of cover.
